The Government of India has issued new rules regarding Online Gaming. It has been said that now along with the country, foreign players will also have to pay 28 percent GST. Domestic online gaming companies will be required to deduct 28 percent GST on bets placed from foreign locations, including overseas players, as such bets will also be treated as actionable claims.

Parliament approved an amendment to this effect in the Integrated GST (IGST) Act on Friday. Tax experts have said that the amendment is aimed at plugging loopholes with regard to the collection of IGST from bets coming from foreign places. At present, in the case of the import of intangible goods such as actionable claims involving online money gaming, which do not physically cross the customs border, IGST cannot be collected through customs.

The CGST Amendment Bill defines 'online gaming' as a game over the Internet or an electronic network. 'Online money gaming' means online gaming in which players bet money or money in any event including a game, scheme, competition, or any other activity. Pay or deposit money, including Virtual Digital Assets (VDA), in the hope of winning VDA, whether or not it is.
