The Aurangabad Bench of the Bombay High Court refused to allow a 15-year-old girl to have an abortion. The minor was raped and she is 28 weeks pregnant.
The High Court quoted the medical board as saying that at this time, to end the pregnancy, the girl would have to be forcibly delivered. Even in this situation, the child will be born alive. That's why it is better to have a natural delivery of the girl. After this, if the girl wishes, she can keep the child with her or give it to an orphanage.
The Medical Board, after examining the girl, had told the High Court that if the pregnancy is terminated now, the child born may have deformities. The baby will not be able to develop fully and will need to be kept in a care unit after birth. In this, the life of the girl will also be in danger.
The High Court said that in any case the child would be born alive. With natural delivery just 12 weeks away, the health and development of the baby also need to be kept in mind. In these 12 weeks, the baby will be completely developed. After this, there will also be a possibility of the child being adopted by someone.
The division bench of Justices RV Ghuge and YG Khobragade gave this order on 20 June. The minor's mother had filed a petition in the court for permission for abortion. He had said in the petition that his daughter had gone missing in February. Later she was found with a man in Rajasthan after 3 months. The police had registered a case against the man under the POCSO Act.
After the court's refusal, the woman said that the girl should be kept in the hospital or NGO till the delivery. On this, the court said that the girl should be kept in a shelter home in Nashik or a shelter home in Aurangabad.
