SC: 'Devastating consequences of harsh firing', life imprisonment given by the High Court, cancelled by the apex court
A bench of Justices Vikram Nath and Satish Chandra Sharma said joyous firing is an unfortunate but prevalent practice in our country. The present case is a direct example of the devastating consequences of such uncontrolled and unjustified harsh firing.
The Supreme Court said that incidents of celebratory firing in celebration of wedding ceremonies are unfortunate and often have disastrous consequences. The apex court made the remarks while quashing the conviction of a man accused of killing another in a rash firing at a wedding in 2016.
Joyous firing, according to the bench of Justices Vikram Nath and Satish Chandra Sharma, is a regrettable but common practice in our nation. The current situation serves as a clear illustration of the disastrous effects of such uncalled-for, severe firing. Shahid Ali's life sentence, imposed by both the trial court and the Allahabad High Court, was revoked by the bench.
But by IPC section 304 part 2 (culpable homicide not amounting to murder), the Supreme Court found him guilty. However, he was released from prison after serving eight years. The prosecution claims that on March 17, 2016, a person by the name of Gulab Ali filed a formal complaint against Shahid Ali at the Jasrana police station in Firozabad, Uttar Pradesh. Shahid fired harshly, killing one person in the process.
