Should the Supreme Court frame guidelines to prevent people in responsible positions from making absurd statements in sensitive matters? The Constitution Bench of 5 judges will decide on this matter today. Justice SA Nazeer will head this bench. He is retiring from service on January 4.
The five-judge bench also included Justice BR Gavai, Justice AS Bopanna, Justice V Ramasubramaniam and Justice BV Nagaratna. According to the court's work schedule for Tuesday, there will be two separate judgments on the matter, which will be pronounced by Justice Ramasubramaniam and Justice Nagaratna.
The Supreme Court reserved its decision in this matter on 15 November. During this, the court had said that people sitting on public posts should not do such things, which are derogatory to the countrymen. During the hearing, the court had said that this behaviour is part of our constitutional culture and for this, it is not necessary to frame a code of conduct for people holding public office.
In fact, in July 2016, this case started after the statement of the then-UP minister Azam Khan in the Bulandshahr gang rape case. He termed it a political conspiracy. After this, the matter reached the Supreme Court and a demand was made to make guidelines to prevent the people sitting in responsible positions from making absurd statements in sensitive matters.
