Supreme Court fined ED 1 lakh: Agency had sought cancellation of bail of cancer victim
Supreme Court imposed a fine of 1 lakh on ED: The agency had sought cancellation of the bail of the cancer-stricken accused.
The Supreme Court has reprimanded the ED for seeking the cancellation of bail of an accused suffering from cancer. The court told the ED officials that you have wasted the time of the court along with stationery, and legal fees. Apart from this, the court also ordered to pay a fine of Rs 1 lakh from the salary of the officer who filed the petition.
Actually, the cancer victim accused is an employee of a private bank. He is accused of cheating to the tune of Rs 24 crore. He was arrested in the same case. The matter reached the Allahabad High Court on 12 November 2021, where the High Court granted bail considering the report of the accused's illness at Kamala Nehru Hospital. The ED had filed a petition challenging this decision of the High Court in the Supreme Court.
A bench of Justices M R Shah and M M Sundaresh observed that as per the circumstances of the case when the accused has been released. On the ground that he is suffering from cancer, then there is no need for any further intervention from the Supreme Court.
The court said that the department will have to deposit this money in the Supreme Court registry within a month. Out of Rs 1 lakh, 50 thousand will be given to the National Legal Service Authority. Apart from this, the remaining amount will be handed over to the Arbitration and Conciliation Project Committee of the Supreme Court.
