Rajasthan High Court's ordered to pay the married daughter considering her dependent on the government employee
Rajasthan HC: The Rajasthan High Court has given an important decision today. The court has issued an order to the PhD department to make the payment for refusing to give benefits to the married daughter of a government employee by not considering her dependent after death. The court was informed that rejecting the petition application was illegal and unconstitutional, after which the Rajasthan High Court gave strict instructions after hearing the petitioner's side.
Rajasthan High Court has passed a very important judgment today. The court has issued a decree to pay to PhD department for denying a married government employee's daughter a benefit by not considering her dependent after death.
The single bench petition filed by petitioner Bhavna Kanwar by Justice Dinesh Mehta in the Rajasthan High Court has instructed the petition department and government to release payment to a married woman.
Advocate Praveen Dayal Dave, appearing for the petitioner, had filed a civil single bench petition in Rajasthan High Court and stated that Shakuntala Bhati, mother of the petitioner, was a government employee in Public Health Engineering Department, who had passed away while in government service, her two sons and a daughter.
The daughter submitted an application to the department to get the posthumous benefits, due to which Shakuntala Bhati did not nominate any family member in her service book, the pension department rejected the application saying that the payment of the outstanding amount, pension, gratuity, and encashment of earned leave is not payable as she is a married daughter as per Rule 54 and Rule 56 of Rajasthan Civil Services Rules Pension Rules 1996.
