Demand for FIR against BJP leaders for hate-speech: SC notice to police, accused Verma-Anurag Thakur of spreading hatred in Delhi riots

The Supreme Court on Monday issued notice to the Delhi Police on a petition by Communist Party of India CPI(M) leaders Brinda Karat and KM Tiwari. Which a demand was made to register an FIR against Union Minister Anurag Thakur and BJP leader Pravesh Verma for alleged hate speech during the Delhi riots in 2020.
A bench of Justice KM Joseph and Justice BV Nagaratna sought a response from the Delhi Police within three weeks. During the hearing, the Supreme Court said that prima facie, it is wrong for the Magistrate to say that someone's approval is needed to register an FIR in a case.
This petition of CPI (M) leaders was heard in the Delhi High Court on June 13, 2022. The High Court had refused to interfere with the order of the trial court which had held that in the existing facts under law, approval of the higher authority was necessary for the registration of FIR.
The High Court had said that the Delhi Police had conducted a preliminary inquiry into the matter and informed the trial court that prima facie no offence was made out. In order to pass an order, the trial court is required to take cognizance of the facts and evidence.
Two complaints have been made in the petition by CPI(M) leader Karat that BJP leaders Anurag Thakur and Parvesh Verma have given inflammatory speeches. According to the petition, on January 27, 2020, Anurag Thakur gave a speech at a rally raising the slogan "Desh ke gaddaron ko, goli maaro saalon ko".
At the same time, Pravesh Verma had given a similar statement on January 27-28, 2020 while campaigning for the Bharatiya Janata Party and later in an interview with the media. During that time the protest against the Citizenship Amendment Bill (CAA) was going on.
