Central Government issued guidelines, people with over 40% disability will get 4% reservation
People with more than 40 percent disability will now get 4 percent reservation. The Central Government has issued comprehensive guidelines. The Central Government has taken this step after the Delhi High Court criticized institutions like Kendriya Vidyalaya Sangathan (KVS). There is a provision of reservation in many categories including visually and hearing impaired, intellectually disabled, and mobility impaired.
The Central government has issued comprehensive guidelines to streamline the reservation and identification of posts for at least 40% of disabled persons. In this, the formation of committees has been made mandatory to identify and evaluate such posts from time to time. Along with this, the provision of 4% reservations in direct recruitment and promotion has also been made in various categories including visually impaired, mobility impaired, hearing impaired, and intellectually disabled.
It has also been said in the guidelines that if a post is considered suitable for disabled persons, then all the subsequent promotion posts will also be reserved for disabled persons. These guidelines are in line with the Rights of Persons with Disabilities Act, 2016.
This move came after the Delhi High Court highlighted anomalies in implementing the Rights of Persons with Disabilities (RPwD) Act, 2016, and criticized institutions such as Kendriya Vidyalaya Sangathan (KVS) for taking unauthorized action in identifying posts.
The court had also directed that similar guidelines be framed by the Department of Empowerment of Persons with Disabilities (DEPwD). New guidelines have been aimed at ushering in inclusiveness, equity, and uniformity in offering jobs to persons with disabilities inside central government establishments. According to these, the identified posts are supposed to be reviewed every three years comprehensively to provide scope for the incorporation of new technological advancements and job requirements. It also conveys the stress on the timely filling of pending vacancies, wide publicity, and a validity period of three years regarding exemption from reservation policies.
