Bombay HC said - only separation of religion is not love jihad: Complainant's allegation- Ex girlfriend got circumcised, pressured to convert to Islam

Bombay HC said - only separation of religion is not love jihad

The Bombay High Court said that a religious angle cannot be given to a relationship just because the boy and the girl belong to different religions. In fact, a man (ex-boyfriend) had accused the woman and her parents of pressurizing her to convert to Islam and undergo circumcision.
The High Court made this remark while granting anticipatory bail to the woman and her parents. The matter was heard on February 26 by a bench of Justice Vibha Kankanwadi and Justice Abhay Waghwase. Although the news has now come to the fore.
In December 2022, the person filed a case of love jihad against ex-girlfriend and her family members. He told that since the year 2018, he was in a relationship with a Muslim woman. He was from the Scheduled Caste (SC) but did not tell the woman about it. After a few days, the woman started pressurizing the man to convert to Islam and marry her. Then the man told his caste to the woman's parents.
The man says that the woman's parents had no problem with her caste. Later, he also persuaded his daughter to adopt me without converting me. Then there was bitterness in our relations. After this, I filed a case against the woman and her parents for pressurizing her to convert, getting her circumcised and asking for money. The man also accused the ex-girlfriend and her family of ill-behaving in the name of caste.
In this case, the Aurangabad Special Court had refused to grant anticipatory bail to the woman and her family, after which they had reached the High Court. The Bombay High Court said during the hearing of the case that it seems that an attempt has been made to give an angle of love jihad in this case. When two people love each other, there is less possibility of love jihad.
The court noted that the case was registered in 2022 and in the FIR the man confessed that he was in love with the woman. In such a situation, the person calling himself a victim could have ended the relationship with the woman if he wanted, but he did not do so.
The High Court said that in the FIR there is talk of circumcision of the man, but it could not be completely clear in the medical report. Experts could not tell whether the circumcision was natural or due to some surgical procedure.
The investigation of the case has been completed and the police will soon file a charge sheet. Now there is no need to keep the woman and her family in judicial custody in this case. At present, the court has given anticipatory bail to all.
Boys born in Muslim and Jewish communities are circumcised. In this, the foreskin of their penis i.e. the skin of the upper part is cut and separated. According to an article on the Healthline website, children are in pain during this time, but they recover completely within 7 to 10 days.
Circumcision in boys also has many benefits. Circumcision improves their hygiene. The risk of sexually transmitted diseases, penile cancer, cervical cancer and urinary tract infections is reduced. Apart from this, boys are also circumcised to treat diseases related to private parts like balanitis, balanoposthitis, paraphimosis and phimosis.
In contrast, female circumcision has no medical benefit, only harm. According to WHO, women have to face problems like severe pain, bleeding, swelling, fever, infection, non-healing wounds and shock immediately after circumcision.
