Supreme Court Stays Lower Court Order, Amer Police Training Land to Remain with Department

A significant relief for the Rajasthan Police Department, the Supreme Court, led by Justices Dipankar Datta and Augustine George Masih, today upheld the status quo regarding a large parcel of land in Amer, Jaipur. This land, where police training and departmental facilities are currently located, remains under police control.

The state, represented by Additional Solicitor General Aishwarya Bhati and Additional Advocate General Shiv Mangal Sharma, argued that the land has been under police use since 1992 and is essential for law enforcement and training operations. They clarified that the land is government property, refuting claims by respondents and their ancestors based on photocopied documents obtained via RTI, which lack legal or ownership validity.

The Court, considering these arguments, ordered a stay on all enforcement actions related to a lower court order that sought to transfer the land to private decree holders, a decision also upheld by the High Court. This interim measure allows the Police Department to continue occupying and operating from the Amer complex until the Supreme Court issues further instructions.
