The woman's petition to the Supreme Court asking for permission to terminate her 25-week pregnancy was denied. The AIIMS report was used by the Supreme Court to reject the petition. The woman's privacy was respected by the court's refusal to make the report public. Based on the AIIMS Delhi report, the vacation bench of Justices Abhay S. Oka and Satish Chandra Sharma made a decision.

The woman told in the petition that she came to know about her pregnancy only on May 17. The woman told that she is not financially strong and is not capable of raising the child. The woman has come to India from Dubai and is currently staying in a hotel. Hearing the woman's petition, the Supreme Court sought a medical report from Delhi AIIMS before May 24. Now the petition has been rejected on the basis of the AIIMS report. On May 27, while hearing the petition again, the court said that 'keeping in mind the medical report, we cannot allow abortion and the medical report will remain on record in a sealed envelope.

Under the abortion law, permission to abort a pregnancy of more than 24 weeks can be given only if the child in the womb is suffering from an incurable or serious disease, or permission to abort can be given in case of saving the life of the pregnant woman.
